I came home today to see that Onemoresolo.net was down. I thought nothing of it at first, then I checked my email. Aparently, I broke three very big rules.

Number 1, there was warez in the upload folder. Thanks guys.
Number 2, no torrent trackers on 1and1 hosting (I'm glad they made that so clear in the FAQ...)
Number 3, no running irc bots with SSH. Something I didn't do. I used SSH once and I just uploaded files.

So, anyway, the uploader is down for good now, as they locked my whole account at 1and1. The tracker will be back as soon as possible, but not with 1and1. I'm having a friend look into hosting the site in Asia somewhere.

So fuck you 1and1!

The files should still be there when it comes back. I'll archive them if possible and see what I can do.

Sorry to hear about that Sparky. Good call on that Asia deal

They locked my account once too. Apparently I was running "unsecure" scripts on my site (something which they mentioned nothing about in their license agreement). I didn't even have anything remotely resembling a script on there at the time. It was ridiculous. They resolved it after about 5 phone calls and twice as many emails. They were real asshats about it. But, since I'm a bitch, and their service is free, I'm still there. When it runs out I'll definitely be switching to someone else.

So, how do they define warez?

Here's the email I recieved:

Quote:
Dear Bill D*******, (Cust: *******)

It has come to our attention that you are hosting copyrighted and/or licensed
files and software (aka, 'warez')

upload/uploads

Please note that the hosting of these files is strictly prohibited by our T&C

http://order.1and1.com/xml/order/Gtc

7.3.
You agree and warrant that your use of the 1&1 Services and
1&1's Equipment, and all sales and distributions, by any and all means, of
any type(s) of Content including, but not limited to, executable files (such as
.EXE), digitized audio/visual files (such as MP3), or archived copies of
copyrighted works (such as .ZIP); goods, including, but not limited to,
videotapes and CD-ROM products, and any type of services by you, which are
advertised and/or promoted by, or are in any other way directly or indirectly
associated with your use of the 1&1 Services or 1&1 Equipment, shall at
all times comply with all applicable laws, including, but not limited to, all
federal, state and local laws throughout the United States of America.

7.10.
You affirmatively represent, agree and warrant that you have and at all times
shall have all necessary intellectual property rights, including, but not
imited to, all copyrights, trademark and service mark rights and rights of
publicity, both in the United States and throughout the world, to reproduce and
disseminate, via the Internet, all data which you store in Web Site Space or
which you otherwise promote, advertise, disseminate and/or distribute to anyone
by your direct or indirect use of the 1&1 Services or 1&1's Equipment,
including, without limitation, all advertising and promotional materials, prior
to and at all times during the time such materials are promoted, advertised,
disseminated or distributed through any direct or indirect use of the 1&1
Services or 1&1's Equipment.

14.3.
1&1 may terminate this Agreement at any time for any reason, with or without
cause, upon thirty days' written notice. 1&1 may suspend performance under
or terminate this Agreement and cease transmission of data associated with Your
Web Site immediately and without notice:

Please remove the requested files from your webspace immediately and reply to
this e-mail. Failure to do so will result in your account being locked and
possibly terminated.

Also, it has come to our attention that you have recently executed and/or attempted to
execute an unauthorized service on your web space:

bitorrent server

Such services are not permitted to run on 1&1's web spaces:

http://order.1and1.com/xml/order/Gtc

7.13.
You agree and warrant that any and all material(s) of every kind which you store
in Web Site Space or transmit using 1&1's Services or Equipment shall at all
times be free from any and all damaging software defects, including, but not
limited to, software "viruses", "worms", "Trojan Horses," and other source code
anomalies, which may cause software or hardware disruption or failure, reduced
computer operating speed, or compromise any security system. You agree that you
will not attempt to access the 1&1 Equipment or web site or another
customer's web site without authorization.

---

This is also stated explicitly to you when you connect via SSH to your account:

"Shell access is provided for web development and not for running irc-bots,
arbitrary tcp/udp servers (e.g. gameservers) or cracking toolkits. Disregard
leads to suspension of your contract."

Please remove the software at this time and do not attempt to use it again. Be
aware that further infractions can result in the suspension or termination of
your contract.

Thank you for your compliance in this matter.

Sincerely,
Brian Vitalo

The site is up today so I can remove the offending files. Of course I'm leaving the torrent tracker there. They'll have to delete my account before I remove it.

Would they count a bittorrent tracker as "an arbitrary tcp/udp server"?
