Unless cisco can come up with proof that they had been planning a launch of the 'iphone' they aren't going to win the case. I'm pretty sure when it comes to copyright, especially when its just a 'name' you need to provide proof that you are developing a product.

Am I right?

No I think that still doesn't count. It doesn't have to be exact spelling to be copyright infringement.

They had a big keynote on the "iTV" also four months ago, because that was what the rumor-mills/public were expecting (That being, an Apple made device known as iTV). Fast forward four months to release and it is the appletv. (This change due to trademark difficulties.)

The phone is 6 months away, everyone was wanting an "iPhone" so they delivered. Six months time it could be called the "apple phone"
