you cant drive a car with a cracked windshield so i don't see why you could buy a car that has one.

I know that under the law the seller has to smog it a couple of weeks prior to sale. If you're selling a vehicle in the state, and are worried about the windshield thing just put a condition on the transfer of title that the vehicle is sold "as is".

Seller has to ensure the car is in drivable condition. I.e:

No cracked windshield.
Working lights, turning, headlights, and brights.
Working windshield wipers.
Street safe tires. (Significant tread) Smog check.

For used cars, a dealer is required to make sure the car is in safe working order before it leaves the lot. This means the car must have brakes, lights, etc.

This is less applicable to private party sales, but if the refuse to fix the windshield before you purchase it, then you can always walk away.
